This Privacy Policy explains how Nine Lives LLC ("Nine Lives," "we," "us," or "our") handles information when you use Zapp, our AI game generation application, and its related services (the "Service"). Zapp lets you generate games from prompts using credits and play games made by other users. Our Terms of Service are available at https://ninelives.cc/zapp-terms.

1. Information We Collect

We collect information you provide or generate through the Service, which may include:

• Account information, such as your email address, username, profile details, and sign-in information.
• Prompts, uploaded materials, generated games, code, images, audio, and other content you submit or create.
• Subscription status, purchase receipts, credit top-ups, credit balances, and credit usage. App stores or payment providers process payments; we generally receive transaction details rather than your full payment-card number.
• Support requests, feedback, content reports, and other communications with us.

We may automatically collect device type, operating system, app version, IP address, approximate location inferred from IP address, usage logs, generation requests and results, games played and related interactions, crash reports, and security or performance information. Cookies, local storage, and similar app technologies may support sign-in, preferences, and analytics. We may also receive account, transaction, diagnostic, and abuse-report information from authentication providers, app stores, service providers, or other users.

2. How We Use Information

We use information to:

• Create and manage accounts and provide the Service.
• Send generation requests to our backend, process prompts, generate and host games, and make shared games playable.
• Verify purchases, manage subscriptions, and maintain credit balances and usage records.
• Understand usage, troubleshoot failures, and improve game generation, performance, and discovery.
• Respond to support requests, send service and transaction notices, and handle privacy requests.
• Moderate content, investigate reports, prevent fraud and abuse, protect security, enforce our Terms, and meet legal obligations.

Where applicable law requires a legal basis, we process information as necessary to perform our agreement with you, meet legal obligations, pursue legitimate interests such as security and service improvement, or with your consent where required. You may withdraw consent by contacting us without affecting earlier lawful processing.

3. AI Processing

When you submit a prompt or other material, it is sent to Nine Lives' backend and may be shared with AI service providers to generate, process, or review your game. Inputs, outputs, and related technical logs may be stored and processed as needed to provide, troubleshoot, secure, and improve these features. Do not include confidential information or another person's personal information unless you have authority to share it for this processing.

The AI providers and any model-training use of your content depend on the providers and configurations used for the feature. This policy does not promise that all processing occurs on your device or that providers never retain inputs. Contact team@ninelives.cc for details about the providers and data handling applicable to your use; we will provide additional disclosures or obtain consent where required before sharing personal information with third-party AI providers.

4. When We Share Information

We may disclose information to:

• Service providers supporting hosting, storage, AI processing, authentication, payments, analytics, diagnostics, support, security, and moderation, as needed to perform those services.
• Other users and the public when games, creator details, or other content are made available in Zapp's shared game library. Content made public can be played, captured, or shared by others. Do not include information you want to keep private in shared games.
• Authorities or other parties where reasonably necessary to comply with law, respond to legal process, protect rights and safety, investigate abuse, or enforce our agreements.
• Parties involved in a merger, acquisition, financing, reorganization, or sale of assets, subject to applicable protections.
• Other recipients when you direct us to share information or provide consent.

Sharing a game does not by itself mean that your account email or raw prompt is displayed publicly. Any personal information included in the game's visible content may be seen by players.

5. Retention and Security

We retain information for as long as reasonably necessary to provide the Service and for purposes such as security, transaction records, legal compliance, and dispute resolution. Retention depends on the information and purpose. After deletion, limited records may remain in backups or where needed for these purposes; copies of public games captured by others may remain outside our control.

We use reasonable technical and organizational safeguards to protect information. No system is completely secure, and we cannot guarantee absolute security.

6. Your Choices and Rights

You can request access to, correction of, or deletion of your personal information or account by emailing team@ninelives.cc, and use any controls available in the app. Depending on your location, you may also have rights to data portability, restrict or object to processing, withdraw consent, opt out of sale, sharing, or targeted advertising where applicable, or appeal a denied request. We will honor applicable rights and may verify your identity before acting. You may also complain to your local data-protection authority.

Manage device permissions in your device settings and subscriptions through the app store or provider that bills you. Requesting account deletion does not itself cancel a subscription.

7. Children

Zapp is not directed to children under 13 or a higher minimum age required by local law. We do not knowingly collect personal information from children below that age. If you believe a child has provided information, contact us so we can investigate and take appropriate action. Users below the age of legal majority must have a parent or legal guardian's permission to use Zapp.

8. International Processing and Third Parties

Nine Lives is based in the United States. We and our providers may process information in the United States and other countries with different data-protection laws. We use safeguards for international transfers where required by law.

Third-party app stores, payment services, and external websites have their own privacy policies governing information they collect independently. Review those policies when using those services.

9. Updates and Contact

We may update this policy and revise the date above. We will provide additional notice or obtain consent for changes where required by law.
